Rental Reservation Policies

RENTAL AGREEMENT

Please read the following Agreement, sign, date and return to rental office within 24 hours of booking.  If check in date is within the 24 hour window, agreement must be signed and returned immediately with full payment to secure reservation.  The terms and conditions of this Rental Agreement are non-negotiable.

Please review all information for accuracy. Contact Georgia Cabins and Land Rental Office at 706-455-3109 or 706-946-4770 immediately with any corrections or errors. Please reference transaction number Transaction ID when calling.

This agreement constitutes a contract between the Guest(s) and VCD Investments, Inc. d/b/a Georgia Cabins and Land Rentals. 

Georgia Cabins and Land Rentals serves as the agent representative of all owners of rental homes in our rental program, and are acting at all times, in and for the best interest of the home owners.  The owners of Georgia Cabins and Land Rentals, Vincent and Christal Davis, are licensed realtors in Georgia.

CHECK IN TIME – Check In time is 4:00 pm or later at Georgia Cabins and Land Rentals Office.  Georgia Cabins and Land Rentals will use all reasonable efforts to have the cabin ready for occupancy at check in time, but cannot guarantee the exact time of occupancy.  Keys are not released to property until property is ready for occupancy. Early check in may be requested for an additional fee of $25.00.  Early check in must be coordinated and pre arranged by Agent.

ARRIVAL AT PROPERTY - In case of emergencies, upon arrival at the property familiarize yourself with the property.  The property name, address, phone # (if property has land line), and emergency contact numbers are posted on the refrigerator.  Please locate the fire extinguisher and all exists. All properties should have a sign at the driveway with Georgia Cabins and Land Rentals and property name. 

CHECK OUT TIME -  Check Out time is 10:00 am.  Guest(s) are not considered checked out until Keys to cabin have been returned to office.  Late check outs may be requested for an additional fee of $25.00 and must be coordinated and pre arranged by Agent.  If a late check out is arranged, check out time is to be no later than noon.  If GCLR office is closed, please drop the keys in the drop box to the right of the office door.

 

RESERVATION REQUIREMENTS - A signed Rental Agreement, copy of valid driver’s license and a valid credit card is required to secure reservation.  Half of the total balance is due at the time of booking with Visa, Mastercard, or American Express.  The remaining balance is due 7 days prior to check in and may be made with one of the accepted credit cards, money order or a check drawn on a US Bank. 

Final payment will be charged against the credit card on file 7 days prior to check in. (If check in date is within 7 days of the booking date, the total balance is due in full at the time of booking).

Check/Money Order Payments:  If check or money order is used to secure reservation, payment must be received within 3 days of reservation date by Georgia Cabins and Land Rentals or the reservation will be cancelled.  If final payment (remaining balance) is made by check or money order, it must be received in the office 7 days prior to check in. (Please state Transacton ID # on all money orders or checks submitted as payment).  If final payment is not received 7 days prior to check in, any remaining balance will be automatically charged to the credit card on file.  If any payments made with a check are returned for NSF, the credit card on file for security will be charged for the balance plus a $25.00 returned check fee.

SECURITY DEPOSIT – The primary credit card or any other type of credit card provided for payment may be used as form of security by Agent for any guest fines, fees or additional services due to guests neglect, misuse or damage.  At the time of check in a security deposit hold will be placed on the credit card for $250.00.  This hold will be released 7 days after check out date in the event that no damage is found and all policies and procedures have been followed.  Note, please be sure to follow all policies and check out procedures to avoid loosing a portion or all of the security.

CHECK OR MONEY ORDER PAYMENTS:  A valid credit card is required for the $250.00 security deposit to be placed on hold at the time of check in.  If Guest(s) does not have a credit card to use for security, Guest(s) will need to provide cash or money order in the amount of $250.00 for security at time of check in.  NO PERSONAL CHECKS ACCEPTED AT CHECK IN FOR SECURITY.  Guest(s) using this form of payment for security must check in during business hours.  No after hours check in.  The security deposit will be returned via a GCLR check 7 days after check out date in the event that no damage is found and all policies and procedures have been followed.  Note, please be sure to follow all policies and check out procedures to avoid loosing a portion or all of the security.  No cash refunds.

CANCELLATION – All cancellations request must be submitted in writing via email, fax or certified mail and are not considered complete until Guest(s) receives email confirmation from Agent.  Cancellation fees are as follows:

  • From time of booking until 7 days prior to arrival date:  $ 50.00
  • Within 6 days to 4 days prior to arrival: $250.00
  • Within 3 days or less prior to arrival, Guest(s) Forfeits all monies paid.
  • “No Shows” forfeit all monies paid.
  • *Cancellation policy applies to last minute bookings* 
  • Exceptions apply only at the discretion of the agent.

CONFIRMATION - Reservation confirmation will be sent via e-mail to Guest(s). Please read the confirmation for accuracy: Occupancy dates, pricing, mailing address, phone/e-mail contact information, and any other accommodation requests. Information changes and/or errors should be reported within 24 hours of confirmation, immediately if arrival is within 24 hours of booking.

RESERVATION CHANGES - A $10.00 Change Fee will be assessed for any date and/ or property changes requested to a Confirmed reservation.  However, no rescheduling or date changes can be done 3 days prior to arrival date. 

If guest(s) uses a different or multiple credit cards to fulfill balance of the original reservation, a $10.00 processing fee will apply.  Note: Guest(s) may send multiple checks to fulfill balance at no additional charge.

OCCUPANCY – Guest(s) understands that Agent will only accept reservations from responsible adults 21 years or more with the exception of Mountain Rivers Lodge. Guest(s) must be a minimum of 25 years of age to book this property.  Guest(s) who initiates rental will remain responsible for all other guest(s), children or visitors during occupancy of subject property.  *(A copy of a valid driver’s license is required to secure a reservation).

 Advertised nightly and weekly rates are based on 1-4 people occupancy.  If occupancy exceeds 4 people, guest(s) agree to pay $15.00 per person per night extra.  (Does not include infants and children less than 1 year old).  Guest(s) agree that no more people than the number authorized on the confirmation shall occupy the property.  If property is occupied by more than the number authorized on confirmation, Guest(s) agrees to pay an additional $20.00 per guest per night.

 A visitor(s) of the Guest(s) may occupy the property on a temporary basis only.  Visitors may not occupy the property beyond 10pm or stay overnight.

 NO HOUSE PARTIES!  If evidence of misuse or violation of this agreement is discovered at any time the Guest(s) of record will be charged accordingly or immediately evicted.

HOLD OVERS OR EXTENDING RESERVATIONS-  Guest(s) must contact the office as soon as possible to extend reservation or if guest has become hold over for any reason.  The current nightly rate will be added to the reservation for each additional night along with any other associated charges.  Please be aware that extending days to a reservation may not be available.

 

RATES - Nightly rates and minimum nights are displayed on the individual property description. Rates are based on: Four (4) person occupancy, season, property classification, location, furnishings, and amenities. Published nightly rental rates do not include, tax, cleaning fees, pet fees, Damage Protection Fee, or any additional requested services. Nightly rates are subject to change without notice based on season and/ or occupancy levels. Once a guest has secured a rate it will not change unless the reservation is modified by the Guest(s).

AVAILABILITY - If a property becomes unavailable prior to occupancy due to circumstances outside of Agents control or prior knowledge due to: Termination from rental program, major mechanical failure, or loss of utility (Electricity, Gas, Water) Before offering a refund, Agent reserves the right to relocate Guest(s) to a different rental property, reschedule, or issue a credit for future use. If there are no comparable options the Guest(s) will be given a full refund without penalties.

Agent shall have the sole right to select such replacement rental property for bookings. Guest(s) will be refunded any difference in cost or responsible for any additional costs above collected balance. 

 REFUNDS - All eligible refunds will be issued to the credit card on file or by check and mailed to Guest(s) of record. Cash Refunds are not available. Refunds or rate adjustments are not made for any inconveniences.

No refunds or rent reductions will be made due to failure of appliances and/or equipment, early departures, delayed arrivals, or inclement weather. Some refunds will require an additional reservation change fee.

INCLEMENT WEATHER - It is the Guest(s) responsibility to monitor the weather and road conditions prior to arrival. Guest may contact the office to inquire about conditions understanding that Agent cannot predict the weather or road conditions throughout the region. Road conditions can change quickly and/ or remain impassible for extended periods of time. 

Agent will allow Guest(s) to reschedule within 72 hours of arrival. If guest does not reschedule within this time frame the agreement will not be changed or altered in any way.

If guest becomes hold over the full nightly rate will be charged for each additional night.  It will become the Guest(s) responsibility to pay for any additional services requested.  Guests arriving during this time and checking in (accepting keys / taking occupancy of the property) understands they are proceeding at their own risk and should make the proper arrangements.  Guests who do not show, turn around, or depart early will be voluntarily forfeiting the reservation.

In the winter months the rental company is not responsible if you become stuck or stranded from bad weather, do not have the proper necessities, or become stranded during the trip to the cabin, while at the cabin, or departing the cabin. Roads become treacherous at times in the snow and ice and are dangerous for travel. Please take this into consideration when making your decision to keep original reservation dates or to reschedule.  If the decision is made to keep the reservation, you are coming at your own risk. GCLR is not responsible for any accidents nor any cost, injuries, or inconveniences that may occur.    Travel To Properties - Some properties are posted 4-wheel drive only.  Please adhere to this rule as no refunds are offered for vehicles that can not get to the property.  Guest(s) may also be responsible for repairing road if guest(s) attempts to drive to cabin and gets stuck or causes damage to the road.   Please read ALL the paperwork that is provided at the time of placing the reservation and when choosing a cabin.  Any questions about the terrain and/or getting to the cabin should be asked at the time of placing reservation.

DAMAGE PROTECTION FEE (DPF) – A Damage Protection Waiver can be added to guest(s) reservation for a non-refundable fee of $45.00. This waiver is designed to protect the guest(s) and owner(s) from charges due to accidental damage only. The DPF can provide up to $3,000.00 to repair accidental damages (beyond normal wear and tear). If any damages surpass $3,000.00, additional charges will be applied to the credit card on file and written documentation will be sent to the Guest(s) of record. If damages are determined to be caused by the willful misconduct, misuse, or pets; the Damage Protection Waiver will be voided on the grounds of intentional act(s), gross negligence, willful and wanton conduct by Guest(s) or Licensee of Guest(s), or visitor. These occurrences will result in the Guest(s) credit card on file being charged in full for any damages and management fees. The waiver does not cover any additional management fees or fines.

*ALL ACCIDENTAL DAMAGE MUST BE REPORTED TO THE AGENT'S OFFICE BEFORE GUEST DEPARTURE TO QUALIFY FOR PROTECTION.

CONCIERGE & GUEST SERVICES - Agent has established relationships with service providers throughout North Georgia. Cost of additional services can be added to your final invoice and charged to your credit card for ease of accounting on your vacation. This cost can be verbally requested and confirmed or checked on the GCLR website by guest before it is charged. Once a request is made and reservations confirmed or services rendered all charges are final and non-refundable. Service provider will be responsible for any liability, refunds, or gift certificates. Agent will not be held responsible for any misstatements by Guests, we assume no responsibility for incorrect dates, times, e-mail addresses, or any other incorrect information provided to us by Guests. Excursions are reserved "as is" on the date and times requested by Guests. Agent will not be held responsible for injuries, death, loss of personal effects, or late arrival of Guests to pre-reserved excursions.

SPECIALS, PROMOTIONS & DISCOUNTS - Agent may offer different types of savings. Any special, promotion, or discount must be requested at the time of booking. Some properties maybe exempt. No specials, discounts, or promotions will be given after a reservation has been booked.

LISTING INFORMATION - Property information and individual listings are believed accurate but cannot be guaranteed. We have made every effort to ensure that all the information on the Agent's website(s) is current & accurate. The possibility of errors and omissions exists. Our staff will be happy to confirm all data and information contained herein or will be glad to answer any questions you may have prior to booking your reservation.

ACCOMMODATIONS - All properties are privately owned, furnished, and equipped by the Owner. As such, Agent cannot make any changes to the furnishings or equipment provided by the owner. Each property is cared for by a team and/ or individual housekeeper and is always inspected within at least 2 days of arrival and immediately after departure. If Guest(s) requires special appliances or equipment, please bring them or make arrangements with the Agent's staff prior to arrival. Furnishings are subject to change without notice. Under no circumstances is furniture, bedding, mattress pads, utensils or any other item supplied with the rental property to be taken out, transferred from one property to another rental property, moved, or rearranged. In certain areas of each rental property, there may be locked locations used by the property Owners for personal storage or for Housekeeping supplies. These areas are not included in this rental. Please do not move furnishings or tamper with locked areas, such behavior will result in a fine starting at $100.00 (or more depending on circumstances).

BOAT DOCKS - Some properties may or may not have boats and/or private docks for the guest to use. Guests understand that boat and dock usage is at their OWN RISK and WILL NOT hold Agent or Owner responsible for any injury that might occur. The following rules and regulations govern use of the private docks:

BOATING - Boats are not provided by GCLR or property owner.  Boats of any kind and jet skies that are brought with Guest(s) are the sole responsibility of the Guest(s).  Guest(s) is also responsible for knowing and following all DOT of Georgia rules and regulations and age limits to operate vessels on the water.  GCLR is not responsible for any accidents or violations that may arise from a Guest(s) or a member of the Guest(s) party operating, docking, loading or unloading boat(s) or jet skies.

Swimming: Swim at your own risk. Always wear a life jacket while in the water. No life guard on duty. Stay away from moving boats at all times. Always use a ladder to get back onto the dock - do not attempt to get onto the dock without use of a ladder. Do not place hands, feet or any part of body under platforms or docks as there are sharp objects and metal underneath the docks.

Children Swim Safety: Children age 10 and under must wear a life jacket at all times when on the docks or walkway. Please NO RUNNING on the docks and walkways. Children swimming off swim platform must wear a life jacket and be supervised by a responsible adult at all times.

NO SMOKING ON DOCKS: Gasoline vapors and accidental leaks/spills can cause injury. For this reason, NO SMOKING AND NO OPEN FIRES are permitted on the docks. This includes any grills. If you have a grill mounted on your boat it cannot be used while at the dock, you must be in open water. Dispose of ashes and butts properly in an ashtray or trash can. DO NOT throw lighted butts into the water! Floating fuel or vapors can ignite. No fireworks displays on the property or on the docks.

FISHING – Guest(s) may fish from the docks. Please keep center walkway free of chairs, fishing poles and tackle boxes so other guests may safely navigate. Please be careful casting around boats and fuel lines.  It is the Guest(s) responsibility to be properly licensed and to be informed of all rules and regulations.  GCLR is not liable for any accidents or failure to have proper licensing that may arise from fishing.

QUIET HOURS - Began at 10:00pm and end at 7:00am.

PERSONAL ITEMS ON BOATS - Personal items should be properly stored and boats covered and locked when not in use. Every effort is made to keep the docks secure but Agent is not responsible for items missing or damaged due to theft, wind, or waves. Ropes, hoses, and electrical cords must be coiled on racks or otherwise routed so as not to obstruct walkways. Center walkways MUST be kept clear at all times. Dock boxes are not allowed.

HAZARDOUS MATERIALS- Do not allow waste, fuel, oil, or chemicals to spill into the water. Any cleaning products used must be biodegradable.

TRASH DISPOSAL - Trash receptacles at the docks are for small items. If you have large bags of trash, take them to the dumpster. Do not leave the bags beside the cans as they will attract unwanted pests.

REPAIRS - SERVICE CALLS - EMERGENCY MECHANICAL FAILURE - Guest(s) understands and agrees that Agent cannot guarantee against mechanical systems failure during occupancy. Guest must report any inoperative equipment or needed repairs to the Agent's office as soon as possible. If the office is closed call the after-hours information number provided. Non-Emergency maintenance requests must be reported to the office between 9 AM and 5 PM for same day response. Agent will make every reasonable effort to have repairs completed quickly & efficiently. Agent reserves the right to move Guest(s) to another rental property; if deemed necessary & is subject to availability. No refunds, concessions, or rate adjustments will be made for these unforeseen circumstances. Should a repair technician make a call to a rental property unit and find that the equipment is in working order and the problem was due to the Guest(s) oversight or neglect, a $50.00 service call charge will be charged against the Guest(s) credit card on file. Guest(s) understands and agrees that Agent, Agent's staff, and/ or contractor of Agent may enter the rental property at any reasonable time to make any needed repairs. Each Guest(s) has one courtesy call for questions and/ or to request a tech to come out.  Repeated calls for operating instructions on hot tubs, TV’s, Wii games or other electronics will result in an hourly charge billed to the Guest(s) as an additional fee for service calls.

AFTER HOURS INFORMATION NUMBER - Guest(s) will be provided a telephone number upon arrival for any after-hours emergency or for important questions. If your request is a non-emergency, your request may be forwarded to the following business day. All emergencies will be handled with prompt and thorough care.

DIRECTIONS & PREVIEWING PROPERTIES - Due to liability issues, we are unable to provide prospective Guest(s) with directions or keys to preview properties prior to scheduled arrival unless accompanied by Agent or Agent's staff. A trip fee will be required to preview any properties. Directions and specific property information such as gate and/ or alarm codes will be provided on the day of arrival. Directions from the rental office to the selected property will be provided in the check in packet at check in. 

KEYS - Guest(s) are issued one set of keys at check-in & all keys must be delivered back to Agent's office at time of Check-Out. The properties are privately owned and Guest(s) are responsible for lost, misplaced, or stolen keys. In the event that key(s) are lost, misplaced, stolen or not returned for any reason, Guest(s) will be responsible for the cost of replacing and/ or re-keying the subject property. GCLR will use a professional locksmith to re-key all exterior doors. Costs vary based on quantity.

LOCKOUT - In the event a Guest(s) is locked out of a property, the Guest(s) can borrow a key by coming to the GCLR office during business hours. After business hours, Guest(s) must call the Georgia Cabins and Land Rentals after-hours information number. A representative will assist the Guest(s) by providing a spare set of keys. A $50.00 charge will be assessed for obtaining the key(s) after business hours.

SATELLITE, CABLE TELEVISION & ELECTRONICS - All properties are privately owned and have different subscription packages for cable and/or satellite(s). Agent cannot guarantee any programs, events, or subscription levels. Guest(s) should not attempt to use Pay Per view services or remove any locked channels. Some properties are equipped with sophisticated electronics and stereo equipment. Please do not tamper with this wiring or modify configuration to add a gaming system or other devices. Guest(s) will be responsible for technical services calls to reconfigure wiring. Contact the Agent's office if there are any questions.

TELEPHONE & INTERNET ACCESS - Most all properties are equipped with a telephone line and number. Guest(s) agree to make all long distance calls with a calling card or by calling collect with the assistance of an operator. No long distance calls can be made from the rental property's phone. Properties equipped with telephone based internet may experience service interruptions outside of Agents control. Agent cannot guarantee the speed or proper operation of this amenity. See property description to determine availability.

LINENS & ADDITIONAL LINEN SERVICES - A full supply of linens is provided in each property. Bed linens and bath towels are not changed during your stay unless requested. Bath towels should not be removed from the property or used for cleaning purposes. Do not carry cabin towels out of cabin for use at the lake, river or creek.  Bring beach towels from home for these activities.  Stained, misused, or missing linens will be replaced at Guest(s) expense. A linen service and mid-stay cleaning service may be arranged at an additional cost to Guest(s). Contact the GCLR office for details. Note: Toilet tissue, paper towels, and trash bags are provided but are not replenished during the rental.

TRASH AND / OR LITTER - All trash must be bagged and placed in the trash cans or trash bin made available at the property. If trash cans are full upon arrival, please contact Agent's office. If Guest(s) fills trash cans beyond capacity during occupancy, it is the Guest(s) responsibility to remove additional trash and dispose at a local reciprocal trash station (Mineral Bluff: North on HWY 60 at 515 or Aska Rd: Just South on Aska Rd.) If litter (trash reminisce, cigarette butts, cans / bottles, etc...) are discovered after occupancy, an additional Housekeeping fee and/ or Fine will be assessed and charged to the guest credit card of record.

GRILLS - Properties equipped with outdoor cooking grills will use either propane or charcoal. Propane grills should be turned off after each use. Never use charcoal in a propane grill or move the grill to any other location. Charcoal grills should be cleaned out after each use and gas grills please burn the debris from the grills and clean. If you run out of propane it is your responsibility to obtain more gas for the grill if you wish to use it again. See property description to determine availability.

GAME ROOMS - These additions are provided in select properties and are designed for everyone's enjoyment. Please respect the condition of these amenities and do not rough house or play hard around them. Children should always be monitored while using these amenities. Excessive wear and tear or misuse will result in repair or replacement cost at Guest(s) responsibility.

PETS: Authorized PETS Only: Only certain cabins allow pets. All guests must receive prior approval for pets in our pet friendly cabins and all related costs must be paid. If an unapproved pet belonging to any member of the rental party, or guest of the rental party, is found to be in or on the premises of any cabin, Guest will be removed from the property and in this event Guest(s) agrees that the full rental fee and security deposit will be forfeited and acknowledges that any damage done by said pet shall be Guest financial responsibility.  (Damage to include but not limited to extra cleaning, damage to floors or rugs/carpet and pest control).

SPAS/HOT TUBS: Guest must observe any posted safety information. The Spa cover must be in place and latched when the hot tub is not in use. Children under the age of 18 are not allowed to use the hot tub without constant adult supervision. Temperature of the hot tub should NEVER be elevated above 104 degrees.  Enter hot tub in 15 minute intervals only.  Pregnant woman and young children should not use the hot tub without first consulting a physician. Persons with injuries or medical conditions should consult a physician prior to using the hot tub. Extreme care should be taken to ensure that hair and clothing does not become entangled in the drain(s). Pets are never allowed in the hot tub. ALL TUBS ARE DRAINED AND REFILLED OR BALANCED BEFORE GUEST ARRIVAL. Never enter a hot tub with cloudy water or that has developed an odor due to over usage.  There is a $75.00 convenience charge if Guest requests that the hot tub to be drained, cleaned, refilled and/ or balanced during occupancy.

INDOOR FIREPLACES, EXTERIOR FEATURES & FIREWOOD - Indoor fireplaces and exterior features are available in many, but not all, of the properties. See property description to determine availability.

GAS LOG FIREPLACES - NEVER Rearrange or tamper with gas logs. This is a major safety issue and could be hazardous to your health. Tampering will result in additional charges.

WOOD BURNING FIREPLACES AND OUTDOOR FEATURES - Always start with a small fire and buildup to desired size. NEVER overload wood burning fireplaces or outdoor features. We recommend bringing a starter log and using it to start a small fire. Remember to always check to make sure that the flue is open. If Guest chooses to clean out the ashes; make sure the fire is completely extinguished, use designated equipment, and proper disposal methods.

A small, initial supply of firewood FOR INSIDE FIREPLACES ONLY is provided.  Fire starters and kindling to start fires is not provided.  Wood is not provided for exterior Fireplaces, Camp Fires, Fire Pits, or similar, due to the large volume usage of wood.  *Guest(s) will need to bring firewood for outdoor use.  In the event that the initial supply provided for inside use is depleted, it is the Guest(s) responsibility to replenish the firewood supply during their stay.  Bundles of firewood can be purchased at most all convenience stores.

CHECK-IN AND CHECK-OUT - Guest agrees to follow all check-in and checkout procedures, and understands that the property must be left clean and undamaged. Guest understands that failure to follow the posted check-in and checkout procedures may result in additional fees. Agent reserves the right to further bill Guest for additional cleaning or repairs. (Guest agrees to read all of the documents provided at check-in, as well as those printed in the information book and/or posted policies provided in the cabin.)

TRAVELERS INSURANCE: Upon Guest(s) request a travel insurance policy may be made available by a third party insurance vendor. This policy can cover any monies lost based upon the coverage provided. The option to purchase this travel insurance policy must be exercised at the time of reservation.

GUARANTEE - Agent cannot absolutely guarantee a specific rental property and reserves the right to change assignments without notice or liability if the rental property becomes unavailable.

BEHAVIOR AND DISORDERLY CONDUCT - NOTICE: There should be No drinking of alcoholic beverages by persons under the legal age of twenty-one (21) allowed. Should a Guest(s) or visitor of Guest(s) be arrested for underage drinking or use of any illegal substances while at the rental property, or should Agent or staff of Agent observe a Guest(s) or visitor of Guest(s) under the age of 21 consuming alcoholic beverages or performing illegal activity, this rental agreement will be terminated and the Guest(s) evicted at the discretion of the Agent. Illegal drug use is strictly prohibited. Kegs are not permitted on any property at any time or for any reason. The local authorities will be contacted should Agent have to enforce any of the activities stated above.

FIREARMS, FIREWORKS, & ATV's - These items are strictly prohibited. If any evidence is discovered Guest(s) will be fined up to $500.00 (or more depending on circumstances) and will become responsible for any damages associated with the use of these items. ATV's should be trailer and not used on the property grounds.

SMOKING - SMOKING IS NOT PERMITTED INSIDE ANY PROPERTY!!! Smoking is only permitted outside & cigarette butts should be disposed of in ash trays or designated areas. PLEASE NO SMOKING IN HOT TUBS. There is a $500.00 fine (or more depending on circumstances) when smoking is discovered inside a cabin, hot tub, or for littering. ALL CIGARETTE BUTTS MUST BE FULLY EXTINGISHED, BAGGED AND PLACED IN THE OUTSIDE TRASH CAN.

INTERFERENCE - Neither Owner nor Agent/Broker shall be liable for events beyond their control which may interfere with Guest(s) occupancy, including but not limited to acts of nature, governmental agencies, fire, strikes, war, inclement weather and/ or construction noise from nearby sites. NO REBATES, CONCESSIONS, OR REFUNDS will be offered in these circumstances.

RIGHT OF ENTRY - Guest(s) agree that the Agent/Broker reserves the right to enter the rental property to conduct an inspection at any time or for any reason. Agent/Broker may also enter premises to show property to qualified prospective purchasers but will not do so without permission granted by current Guest(s).

PROPERTIES LISTED FOR SALE BY A REAL ESTATE AGENT - Some properties in the Agent rental program are listed for sale. The Real Estate agent has been informed not to show these properties while occupied by a renter or guest of the property owner. Guest(s) may be called and asked for permission to 'show' a property. From time to time real estate agents under their own free will might attempt to “show” the property to a prospective client without permission. If for any reason a real estate agent shows up unannounced please instruct them to call the GCRL Office. If property is listed for sale, Agent may contact Guest as a courtesy to authorize entry or showing.

AGENCY DISCLOSURE - Georgia Cabins and Land Rentals, serves as the agent & representative of all property owner(s) in its rental program, & is acting at all times, in and for the best interests of the property owner(s). Partner / Owner Christal R. Davis is a licensed Georgia Real Estate Broker.

INDEMNIFICATION AND HOLD HARMLESS - Guest(s) agree to indemnify and hold harmless the Owner & Agent(s) for any liabilities, theft, damage, cost or expense whatsoever arising from or related to any claim or litigation which may arise out of or in connection with Guest(s) use & occupancy of the rental property. This is including, but not limited to, any claim or liability for personal injury or damage or theft of property which is made, incurred or sustained by Guest(s). The terms "Agent" & "Owner" as used in this Agreement shall include their heirs, successors in interest, assigns, employees, agents, and representatives where the context requires or permits. The terms "Guest(s)," "Licensee of Guest(s)" as used in this Agreement shall include Guest(s) heirs, successors, assigns, guests, invitees, representatives and other persons on the rental property during Guest(s) occupancy (without regard to whether such persons have authority under this Agreement to be at the rental property), where the context requires or permits.

VIOLATING AGREEMENT & EXPEDITED EVICTION - Agent may terminate this Agreement if Guest(s) violates any of the conditions set forth herein. Upon notice of termination of this Agreement, Guest(s) shall vacate the Premises immediately and forfeit all monies paid. A material breach of this Agreement by Guest(s), which, in the sole determination of the Agent, results in damage to the Premises, personal injury to Guest(s) or others, a breach of the peace, a nuisance to others, or a violation of criminal law or local code, shall be grounds for termination of Guest(s) tenancy. Violation of any of the rules contained herein will result in IMMEDIATE EVICTION & forfeiture of rent.

DENYING PAYMENT, ADDITIONAL FEES, or FINES - If Agent must obtain legal advice or counsel for matters arising from payment discrepancy involving a Guest(s) or Payment vendor such as a credit card company, Agent will seek rightful payment or collection. If disputes are transferred from Agents management to a collection team or attorney, Guest(s) of record will become responsible for all charges proved to be their responsibility including cost of collection services.

DISPUTES - This Agreement shall be governed by and interpreted in accordance with the laws of the State of Georgia, and shall be treated as though it were executed in the County of Fannin, State of Georgia. Any action relating to this Agreement shall be instituted and prosecuted only in the Fannin County Superior Court, Georgia. Guest(s) specifically consents to such jurisdiction and to extraterritorial service of process.

 

CREDIT CARD GUARANTEE & ACCEPTANCE - By submitting a reservation over the internet or by phone Guest has entered in to a binding contract outlined by the Terms and Conditions of this Agreement. Upon submission Guest is authorizing Georgia Cabins and Land Rentals to bill charges relating to the rental and use of property. Guest accepts and understands that all liability & costs associated with damage due to guest(s) negligence, misuse of property and/ or missing items. Additional charges will be billed to the Guest(s) credit card kept on file for security. All credit card sales are final. Guest(s) understands and agrees to the refund and cancellation policies outlined herein. Any further notices or additional information will be provided upon arrival. Guest(s) signature will be required before taking occupancy. 

Please sign, date, fill in contact information along with email address and return to rental office within 24 hours of booking.  If check in date is within the 24 hour window, agreement must be signed and returned immediately with full payment to secure reservation.
